Provides leadership and oversight to school districts under the jurisdiction of BOCES in the organization, analysis and evaluation of districts' compliance with Education Law 2-D, and the Parents Bill of Rights. Consults with school districts on their needs in terms of data privacy and security and provides assistance in the development and implementation of policies and procedures. Data Privacy Service: This service provides in-district support in meeting the requirements of NYS and Federal data privacy laws and regulations including but not limited to NYS Part 121 (Protecting Personally Identifiable Information) QUALIFICATIONS, EXPERIENCE AND COMPETENCIES:Master’s degree in Educational Leadership or comply with Civil Service job description and qualifications.Minimum of three (3) years of successful administrative experience with increasing levels of responsibilitiesExperience with Excel, Access, and/or other statistical software packagesKnowledge of use of data for program and district-wide decision makingKnowledge of technology and procurements preferredExperience in data protection and legal compliance- preferredAbility to handle confidential informationEthical, with the ability to remain impartial DUTIES AND RESPONSIBILITIES:Serves as the primary contact for component districts for data privacy and security.Collaborates with district technology committees to develop strategic data privacy plans that incorporate best practices in compliance procedures.Implements privacy governance measures to manage the use of PII to ensure compliance with NYS and Federal data privacy laws and regulationsParticipates in the investigations of all component district data breach complaints. Supports the Shared Data Protection Officer(s) in making recommendations for resolutions.Researches local, state and national standards and best practices in data privacy and integrates this information into training programs and support provided to component school personnel and BOCES.Provides access to resources and programs available to school districts for professional development and instructional support in the area of data privacy and security.Analyzes district PII data collection, processing and transmission of PII practices. Provides recommendations for adherence to NYS Ed Law 2D and all other NYS and Federal data privacy laws and regulations. Monitors and enforces recommendations.Develops recommendations for provisions to contracts with 3rd party contractors regarding confidentiality of shared student data or teacher or principal data. Identifies contracts that this pertains to.Develops, analyzes, updates Bill of RightsEnsures the district has a Bill of Rights and it is visible on the website.Identifies and organizes contracts with PII that should include Bill of RightsEnsures Bill of Rights includes the required information per 2D 121.3Establishes / Recommends procedures to address complaints about possible breaches or unauthorized release of student data.Develops Data Security and Privacy Policy in adherence to requirements set forth in Ed Law 2d (5)(b)(1) and (2) by July 1, 2020Ensures each 3rd party contractor contract includes the 3rd party’s data security and privacy plan in accordance with Ed Law 2d 121.6Develops a data privacy and security awareness training to be delivered to employees with access to PII on an annual basis (at a minimum). Ensures that all 3rd parties that will receive student, teacher, principal data will also meet Ed Law 121.9 requirementsDocuments reporting and notification procedures in the event of breach and unauthorized release for district to follow.Serves as a liaison with technology resources and networks, including the New York State Education Department on changes to Education Law 2-D and facilitates communication and sharing among shared data protection officers.Represents the BOCES on various local and state-wide data privacy and security committees.Analyzes and reviews access to student data.Reviews requests for new applications/programs to determine compliance with Ed Law 2D; Provides recommendations to district. Performs data related tasks including running and distribution of reports, importing and exporting data.Develops a scope and sequence of DPO learning and themes. Holds county-wide meetings offering expertise to in-district DPOs and other interested parties.Perform other tasks as assigned by the Technology Coordinator, the Deputy District Superintendent, or the District Superintendent.
